Family Rights & Privacy Act

Family Educational Rights and Privacy Act Under the Family Educational Rights and Privacy Act, the parent of a student or the student, once he/she has reached eighteen (18) years of age (eligible student), is entitled to inspect and review all educational records of the student maintained by the school system.

If the parent of a student or an eligible student believes that information contained in the education records of the student is inaccurate or misleading or violates the privacy or the other rights of the student, he/she may request that the records be amended.

School officials are permitted to disclose any and all education records, including disciplinary records and records that were created as a result of a student receiving special education services, to another school or post secondary institution at which the student seeks or intends to enroll.

The school system may publish directory information relating to a student, including the following: student's name and grade, the school the student is attending or most recently attended, dates of attendance, date of graduation, awards received, participation in officially recognized activities and sports, the weight and height of members of athletic teams, photograph and pictures or videos taken on buses, school grounds, in school buildings and of school activities unless the picture or video may reveal confidential information about the student. Also, the No Child Left Behind legislation requires school districts to release additional student information than that previously outlined. However, the release of additional student information, namely home address and telephone number, may be released to representatives of the United States military and institutions of higher education. A parent or guardian who does not consent to release any or all of the above directory information shall contact their servicing school no later than thirty (30) days after the beginning of the school year. Please be reminded that if your child participates in school events that are open to the public, these are PUBLIC events where photography and media coverage are permitted. Further information concerning the school board policy on student records may be obtained by viewing contacting the Superintendent's office.

Parents should also be reminded that an additional provision of the No Child Left Behind legislation allows parents to inspect any third-party surveys that may be administered to students. Questions should be addressed to the MCS advisor for Community Relations at the address above.
